Terms of Service

Last Updated: October 2026

Welcome to Wakamura Legal Support. By requesting services, placing an order via our website, submitting legal documents, or hiring Wakamura Legal Support (“Company,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by the following Terms of Service.

1. Scope of Services & No Legal Advice

Wakamura Legal Support provides registered and bonded process serving, court document filing, field inspections, courier delivery, and skip tracing support throughout Orange County and the State of California.

Wakamura Legal Support is not a law firm and does not provide legal advice, legal representation, or legal strategy. No communication, written or verbal, between the Client and Wakamura Legal Support shall be construed as legal advice.

2. Client Responsibilities & Accurate Information

  • Document Accuracy: Client is solely responsible for providing complete, accurate, and legible court documents, summons, complaints, subpoenas, or notices to be served.

  • Target Information: Client must provide the most accurate known address, physical description, and relevant safety/threat details regarding the individual or entity to be served.

  • Legal Authorization: Client warrants that they have the legal authority to request service of process or field inspections for the documents provided.

3. Service Attempts, Diligence & No Guarantee of Personal Effectuation

  • Diligent Execution: Wakamura Legal Support executes all service requests in compliance with the California Code of Civil Procedure (CCP § 413.10 et seq.) and applicable local court rules.

  • Attempt Limits: Standard process serving orders include up to three (3) diligent attempts at the target address provided by the Client, unless otherwise agreed in writing or governed by a specific rush tier.

  • No Guarantee of Success: Fees are earned for diligence and attempts made, not for guaranteed physical handoff. If a subject avoids service, moves, gives false information, or the address provided is invalid, full service fees still apply.

  • Substituted Service: Where permitted by California CCP § 415.20, substituted service will be executed after due diligence has been met, and Proof of Service will be drafted accordingly.

4. Fees, Quotes & Payment Terms

  • Pre-Payment & Retainers: Unless credit terms have been explicitly extended to established law firms or corporate accounts, all orders must be paid in full prior to field service or document filing.

  • Fixed & Variable Fees: Quoted rates cover standard field attempts within specified geographic zones. Additional fees may apply for incorrect addresses, additional service attempts beyond contract terms, wait time ($60/hr after first 15 minutes), or out-of-area mileage.

  • Non-Refundable Status: Once a process server or field inspector has been dispatched to an address, field fees are non-refundable regardless of whether service was completed, canceled by the Client mid-attempt, or deemed unserviceable.

5. Proofs of Service & Declarations

Upon completion of service (or exhaustive due diligence), Wakamura Legal Support will provide a signed Proof of Service or Declaration of Due Diligence compliant with California judicial standards.

  • Client is responsible for reviewing Proofs of Service for accuracy prior to filing with the court unless e-filing services were explicitly requested.

  • Notarization or specialized declarations are available upon request for an additional fee.

6. Safety, Compliance & Refusal of Service

Process servers act as independent officers of the court. Wakamura Legal Support reserves the right to suspend or terminate any service request immediately if:

  • The service environment presents an immediate physical threat, violence, or illegal activity.

  • The Client requests actions that violate local, state, or federal laws, or California process serving statutes.

7. Limitation of Liability

To the maximum extent permitted by California law:

  • Wakamura Legal Support shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of delays caused by government offices, court clerk backlogs, adverse weather, inaccurate Client-provided data, or evade attempts by recipients.

  • Total liability for any claim arising out of an order shall not exceed the total fees paid by the Client to Wakamura Legal Support for that specific order.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action or dispute arising out of these terms or our services shall be brought exclusively in the state courts located in Orange County, California.
